These General Terms and Conditions govern the contractual relationship between FONCAM, a land consultancy firm based in Cameroon, and any individual or legal entity, local or international, using its services. They apply to the following services: land verification, land registration/title, inheritance settlement, dispute resolution, subdivision, land development, duplicates, waivers, and personalized services for the diaspora.
Any order for services gives rise to:
FONCAM reserves the right to refuse any assignment deemed: illegal or fraudulent, inconsistent with its values, incomplete, or legally risky.
Fees are fixed in advance and can be:
Unless otherwise specified, the regulations follow the following pattern:
Payments are made by bank transfer, mobile money, or any method specified in the quote. No processing will begin without a deposit.
FONCAM undertakes to implement the necessary resources to complete the project within the estimated timeframes communicated to the client.
These timeframes may vary depending on:
All transmitted information is treated confidentially.
FONCAM undertakes not to disclose any information without the client’s written consent, except in cases of legal obligation.
FONCAM cannot be held responsible:
The customer remains solely responsible for the accuracy of the information he/she provides.
FONCAM works with a network of professionals (notaries, surveyors, experts) to carry out its services.
If any of these partners intervene at the client’s request, coordination must go through FONCAM, unless otherwise agreed in writing.
This structure ensures better follow-up, legal security, and clear responsibility allocation.
If this coordination is not respected without prior written agreement, FONCAM reserves the right to suspend or terminate the service without refunding any amounts already paid.
FONCAM reserves the right to delegate certain tasks to approved partners or subcontractors (surveyors, lawyers, topographers, etc.).
FONCAM commits to working only with competent service providers and to ensuring continuity of service quality.
However, these providers remain directly responsible for their own areas of expertise.
In the event of significant changes (e.g., different actual land area, latent conflict, increased notary or land tax fees), FONCAM reserves the right to adjust its fees after informing the client in advance.
External costs (stamp duties, taxes, notary fees, etc.) are not included in the services, unless explicitly stated.
For diaspora clients or remote signature cases, a 7-day withdrawal period applies after confirmation of the assignment, except in cases where execution has already started or where a land-related emergency is justified.
Any dispute will first be addressed amicably (discussion, mediation).
If no resolution is reached, the competent court shall be the First Instance Court of Yaoundé, unless otherwise stipulated or agreed.
